Affiliate Agreement

This agreement governs the relationship between MODC+ and every approved affiliate partner on the MODC+ Partner Platform. By applying to and being accepted into the affiliate program, you agree to the following terms.
1. Relationship
As a MODC+ affiliate partner, you are an independent contractor. Nothing in this agreement creates an employment, agency, partnership, or joint venture relationship between you and MODC+. You are solely responsible for your own taxes, insurance, and compliance with local laws.
2. Commission & payment terms
Commission rates are set per product and displayed on your affiliate dashboard. Commissions are earned when a referred customer completes a qualifying purchase. All commissions are held for a 14-day pending period before becoming approved. Approved commissions accumulate until they reach the $50 AUD minimum payout threshold, at which point they are eligible for withdrawal. Payouts are processed in AUD.
3. Prohibited promotional methods
You may not promote MODC+ products using spam, unsolicited messages, misleading health or legal claims, fake reviews, or any method that violates applicable laws. You may not bid on MODC+ brand terms or product names in paid search advertising without prior written approval. You must ensure all promotional content is truthful and does not misrepresent the products.
4. Compliance & disclosure
You must disclose your affiliate relationship when promoting any MODC+ product, in compliance with FTC (US), ACCC (Australia), ASA (UK), and equivalent guidelines in your jurisdiction. This includes adding appropriate disclosure language to social media posts, blog articles, videos, and any other promotional content.
5. Termination
Either party may terminate this agreement at any time. MODC+ may suspend or terminate your affiliate account immediately if you breach this agreement, engage in fraudulent activity, or damage the reputation of MODC+ or its products. Upon termination, any pending commissions that have not yet been approved will be forfeited. Approved but unpaid commissions will be paid out within 30 days of termination.
6. Refunds & clawbacks
If a referred customer obtains a refund, the associated commission is reversed. Commissions still in the 14-day pending period are cancelled automatically. For commissions that have already been paid, the refunded amount will be deducted from your future earnings. In cases of chargebacks or disputes, the commission is reversed immediately pending resolution.
